CARTRIDGE SAVE “A Picture Is Worth A Thousand Words” COMPETITION – TERMS & CONDITIONS OF ENTRY

 

1. The promoter of the competition

The promoter of the competition is: Cartridge Save Limited of 5-6 Gregson Road, Stockport, SK5 7SS (“Cartridge Save”), and the competition and any publicity or marketing activity relating to the competition will be administered by Democracy PR Limited (“Democracy”) of 1st Floor The Box Works, 62 Beech Road, Manchester, M21 9EQ.

 

2. The competition

2.1 The title of the competition is “A Picture Is Worth A Thousand Words”.

2.2. Win up to £1,000 by uploading a photos/photos that best captures a life defining moment with a caption: https://www.cartridgesave.co.uk/printwhatmatters/a-picture-is-worth-a-thousand-words

 

3. How to enter

3.1 The competition will run from 10:00 AM on 8 June 2020 (the “Opening Date“) to 11:59 on 20 July 2020 (the “Closing Date“) inclusive.

3.2 All competition entries must be received by Cartridge Save at the web address set out at condition 2 above by no later than 11:59 on the Closing Date. All competition entries received after the Closing Date are automatically disqualified. 

3.3 To enter the competition, submit an online entry form at the web address set out in condition 2 above, which must include the following information:

(a)Your name;

(b)Your contact e-mail address;

(c)Your contact telephone number;

(d) Photograph(s) which you have permission to use to enter the competition, and for us to use in the course of the competition as set out in these terms and conditions;

(e) A short caption describing how this image captures a life-defining moment. As per condition 3.3 (b) above; and

(f) Details of your Parent, Guardian or Carer if you are under the Age of 18, and confirmation of their permission for you to enter the Competition as set out in these terms and conditions by the Closing Date

3.4 No purchase is necessary, and there is no charge to enter or submit an entry through the web address referred to in condition 2.2 above.

3.5 Cartridge Save will not accept:

(a)responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or 

(b)proof of transmission as proof of receipt of entry to the competition.

3.6 By submitting a competition entry as described above, you are agreeing to be bound by these terms and conditions.

3.8 Entries into the competition will be split into three categories, based on the age of the entrant: Under-18s, 18-50 and Over-50. 

3.9 Up to 25 of the competition entries will be shortlisted by Cartridge Save (acting in its sole discretion), before being made available for public vote via the web address referred to in condition 2.2 above. The public vote will account for 25% of the final judging process, as set out below. 

3.10 The 25 shortlisted entries will then be judged by a panel of three expert judges, taking into account the results of the public vote referred to in condition 3.9 above. A winner will then be selected for each category, as well as an overall winner. The decision of the Cartridge Save in shortlisting entries and the panel of expert judges referred to above (acting reasonably) will be final.

3.11 A list of names of the judges can be viewed at the web address referred to in condition 2.2 above from the Closing Date for a period of no less than 60 days.

 

4. Eligibility

4.1 The competition is only open to all residents in the UK, except:

(a) employees of Cartridge Save or its holding or subsidiary companies;

(b) employees of agents or suppliers of Cartridge Save or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or

(c) members of the immediate families or households of (a) and (b) above.

4.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim any prize. Cartridge Save may require you to provide proof that you are eligible to enter the competition.

4.3 Cartridge Save will not accept competition entries that are, or have been:

(a) automatically generated by computer;

(b) completed by third parties or in bulk;

(c) altered, reconstructed, forged or tampered with; or

(d) incomplete.

4.4 There is a limit of one entry to the competition per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

4.5 Cartridge Save reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the competition.

4.6 Competition entries cannot be returned.

 

5. The prizes

5.1 The prizes are: £250 for each winner of the categories referred to in condition 3.8 above, and £1,000 for the overall winner of the competition.

5.2 The prizes are not negotiable or transferable.

5.3 In order to claim any prize, winners must contact Democracy within seven days of being notified by Cartridge Save that they have won.

 

6. Winners

6.1 The decisions of Cartridge Save and the judges nominated by Cartridge Save are final, and no correspondence or discussion will be entered into.

6.2 Democracy will, on Cartridge Save’s behalf, contact the winner personally as soon as practicable after the Announcement Date referred to in clause 6.3 below, using the telephone number or email address provided with the competition entry. Cartridge Save or Democracy will not amend any contact information once the competition entry form has been submitted.

6.3 Cartridge Save must either publish or make available information that indicates that a valid award took place. To comply with this obligation, Cartridge Save will publish the surname of each winner and, their winning entries on the website referred to in clause 2.2 above on 8 September 2020 (Announcement Date). 

6.4 If you object to any or all of your or your children’s personal data submitted within your entry being published or made available, please contact Democracy at [INSERT CONTACT DETAILS]. In such circumstances, Cartridge Save must still provide the information and winning entry to the Advertising Standards Authority or Information Commissioner’s Office on request. 

 

7. Claiming a prize

7.1 If you are the winner of any prize, you will have seven days from the Announcement Date to claim that prize by contacting Democracy at cartridgesave@democracypr.com. If you do not claim a prize by this date, your claim will become invalid.

7.2 Prizes may not be claimed by a third party on your behalf.

7.3 Democracy will make all reasonable efforts to contact each winner. If a winner cannot be contacted or is not available, or has not claimed their prize within seven days of the Announcement Date, Cartridge Save reserves the right to offer any prize to the next eligible entrant selected from the other entries that were received before the Closing Date.

7.4 Cartridge Save or Democracy do not accept any responsibility if you are not able to take up any prize.

 

8. Limitation of liability

Insofar as is permitted by law, Cartridge Save, its agents, distributors or marketing, public relations or communications service providers will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up any prize except where it is caused by the negligence of Cartridge Save, its agents, distributors or marketing, public relations or communications service providers or that of their employees. Your statutory rights are not affected.

 

9. Ownership of competition entries and intellectual property rights

9.1 Cartridge Save does not claim any rights of ownership in your competition entry.

9.2 You agree, either on your own behalf or on behalf of any entrant below 18 years old that Cartridge Save may, but is not required to, make your entry available at the web address referred to in condition 2.2 above via and any other media, whether now known or invented in the future, and in connection with any publicity or operation of the competition. You agree to grant Cartridge Save and to Democracy PR a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in your competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence any competition entry and any accompanying materials for such purposes.

 

10. Data protection and publicity

10.1 Cartridge Save will only process your personal information as set out in these terms and conditions. 

10.2 By entering the competition, you agree either on your own behalf or on behalf of your children to allow Cartridge Save and Democracy to use, for the purpose of the operation and promotion of the competition and any related marketing or public relations activity, to use any and all personal data contained within your entry including, but not limited to any photograph. 

10.3 You do not object, either on your own behalf or on behalf of your children, to either Cartridge Save or Democracy (acting as a provider of marketing and public relations services to Cartridge Save) storing copies of your personal data including, but not limited to any photograph for the purposes referred to in clause 10.2 above.

10.4 You have the right to withdraw, either on your own behalf or on behalf of your children, the consent you have given at any time by contacting Democracy at cartridgesave@democracypr.com. This will not affect the lawfulness of any processing carried out by Cartridge Save or Democracy before any consent it withdrawn.

10.5 Cartridge Save is the controller and responsible for the personal data contained within your entry including, but not limited to, any photograph and Democracy is a processor of personal data on Cartridge Save’s behalf in relation to the operation and promotion of the competition.

10.6 Cartridge Save will ensure that it complies (and that Democracy comply) with the requirements or any and all legislation and regulatory requirements in force from time to time relating to the use of the personal data within your entry including, but not limited to, any photograph and will process that personal data in accordance with its privacy policy, which can be found here: https://www.cartridgesave.co.uk/privacypolicy.html 

10.7 Please see also condition 6.3 and condition 6.4, with regard to the announcement of winners.

10.8 You confirm, either on your own behalf or on behalf of any entrant below 18 years old, that you have consent from any individual which features in any image contained in your entry to include and submit it as an entry into the competition.

11. General

11.1 If there is any reason to believe that there has been a breach of these terms and conditions, Cartridge Save may, at its sole discretion, reserve the right to exclude you from participating in the competition.

11.2 Cartridge Save reserves the right to hold void, suspend, cancel, or amend the competition where it becomes necessary to do so.

11.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
